These terms apply when you engage Swinn Digital ("we", "us") for web design, development, hosting, domains, Microsoft 365, maintenance or related services. We'll always confirm the specifics of your project in a written quote or proposal — where that document and these terms differ, the quote takes precedence.
Quotes & proposals
We provide a written quote or proposal describing the scope, price and rough timeline for your project. Quotes are valid for 30 days and a project is booked once you accept it in writing and, where applicable, pay the deposit. Work outside the agreed scope is quoted separately before we start it — no surprise invoices.
Fees & payment
- Build projects: unless stated otherwise, a deposit is payable to book the work, with the balance due before the site goes live.
- Free and monthly plans: where a build is offered free or at a reduced price, it is tied to an ongoing hosting & support plan on a minimum 12-month term.
- Hosting, support and subscriptions are billed in advance on a recurring basis.
- Invoices are payable within 7 days. We may pause work or suspend services on overdue accounts after reasonable notice.
All prices are in Australian dollars. Prices are inclusive or exclusive of GST as stated on your quote.
What we need from you
To keep your project on track we'll need timely feedback, approvals and any content you're providing — text, images, logos and access to accounts (such as your domain or hosting). You confirm you own, or have permission to use, any material you supply. Delays in providing these may affect your timeline.
Timelines & revisions
Timelines in a quote are estimates and depend on both sides keeping things moving. Each project includes a reasonable number of revision rounds as described in your proposal; substantial changes of direction after sign-off may be quoted as additional work.
Ownership & intellectual property
Once your project is paid in full, you own the final website design and the content you provided. We may retain ownership of underlying tools, code libraries, frameworks and techniques we reuse across clients, and grant you a licence to use them as part of your site. Any third-party assets (fonts, stock imagery, plugins) remain subject to their own licences. We'd love to credit your project in our portfolio — let us know if you'd prefer we didn't.
Hosting, maintenance & support
Where you're on a hosting or support plan, we'll keep your site hosted, updated, backed up and monitored as described in that plan. We aim for high availability but can't guarantee uninterrupted service, and we're not responsible for outages caused by third-party providers or events outside our control. Plans renew until cancelled with reasonable notice, subject to any minimum term.
Third-party services
Your project may rely on third-party services such as domain registries, Microsoft 365, payment gateways or e-commerce platforms. Those services are governed by their own terms, and their fees may be separate from ours.
Cancellation
You can cancel a project or plan by contacting us. Deposits and work completed up to the cancellation date are non-refundable, and any outstanding minimum-term amounts may still apply. On cancellation of hosting we'll help you export your site and move to another provider.
Warranties & liability
We take real care in our work, but to the extent permitted by law we provide our services "as is" and our total liability for any claim is limited to the fees you've paid us for the relevant service. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.
Governing law
These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction over any dispute.
